Oberto’s FUEL UP Sweepstakes Official Rules Three ways to participate between 12:01 AM Eastern Time (“ET”) on 9/15/09 and 11:59 PM ET on 12/15/09 (the “Promotion Period”): 1) ONLINE: Visit ultimatealphazone.com & follow the directions provided to complete & submit the online Official Entry Form and receive one (1) entry in the sweepstakes. 2) TEXT: Text keyword “FUEL” to 433339 from your SMS capable handset and automatically receive one (1) entry in the sweepstakes. NOTE: Standard text messaging rates apply. Wireless service providers may charge for each standard text message sent & received. See your wireless service provider for pricing & service plan before entry. 3) Wireless Application Protocol (“WAP”): During the Promotion Period, visit http://oberto.mobi using your WAP enabled wireless device and complete the Official Entry Form to receive one (1) entry in the sweepstakes. NOTE: You may be charged for WAP service according to the terms of your service agreement with your service provider. You must be a wireless service subscriber with a WAP enabled wireless device to enter via this method. Check your phone capabilities for specific WAP instructions. There is a limit of one (1) entry per person, per email address and per wireless number for the entire Promotion Period, regardless of the method of entry. Multiple entries received from any one person, email address or wireless number after the first entry received from that person, email address or wireless number will be void. If a winner is a text message sender, prize will be awarded to the individual named as the authorized account holder of the wireless phone number from which the text message was sent provided he/she has complied with these Official Rules. In the event a winning account selected is a joint account, a total of one prize will be awarded in the names of said joint account holders. The “authorized account holder” of a wireless phone number is defined as the natural person who is assigned a wireless phone number by a wireless service provider or other organization that is responsible for assigning the wireless phone number associated with the submitted text message. In the event of a dispute as to the identity of an online entrant, entry will be awarded to the person named on the applicable online entry form (regardless of whether that is the name of the authorized account holder of the email address from which said online entry form was submitted) and he/she must comply with these Official Rules. All entries become the property of the Sponsor and will not be acknowledged or returned. Released Parties are not responsible for lost, late, stolen, incomplete, damaged, garbled, delayed, undelivered, inaccurate, misdirected entries, text messages or transmissions, interrupted or unavailable network, server, Internet Service Provider (ISP), cable, satellite or other connections, miscommunications, failed computer hardware or software or telephone transmissions or technical failures, malfunction of phones (including wireless phones/handsets), phone lines or telephone systems or other communication malfunctions, cellular equipment tower, telephone systems, wireless service problems, errors or malfunctions, garbled, misrouted, scrambled transmissions or other errors or problems of any kind whether mechanical, human, network or electronic or otherwise relating to or in connection with the sweepstakes, including, without limitation, errors which may occur in connection with the administration of the sweepstakes, the announcement of the prizes, the processing of entries; for inaccurate entry or other sweepstakes related information, printing, typographical or other errors appearing in these Official Rules, or in any other sweepstakes related materials. By participating, entrants agree to abide by these Official Rules and to the decisions of the Sponsor and judges, which shall be final and binding in all matters relating to this sweepstakes. Drawing: Potential winners will be selected by P/S/T in a random drawing conducted on or about 12/18/09 from among all eligible entries received for the entire Promotion Period. Odds of winning will depend on the number of eligible entries received for the entire Promotion Period. Potential winners will be notified by email, telephone, U.S. mail and/or overnight express. By entering, entrants agree that Sponsor & its designees shall have the right & permission to use entrant’s name &/or picture &/or likeness, biographical information or voice for trade, advertising, promotional &/or any other purpose in any media now or hereafter known throughout the world in perpetuity without any further compensation, consideration, permission or notification except where prohibited by law. By entering, entrants agree that the Released Parties shall have no liability & will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to void suspect entries &/or modify, terminate or suspend this sweepstakes should a virus, bugs, non-authorized human intervention or other causes which corrupt or impair the administration, security, fairness or proper play of the sweepstakes &, in the event of termination of the sweepstakes, at its discretion, select the winners from all eligible, non-suspect entries received prior to event requiring such termination.
